ON-SITE VERBAL HOME-CHECK CONSULTATION AGREEMENT (Waiver of Written Home Inspection)

The Parties Understand and Voluntarily Agree as follows:
 
1. CLIENT may take notes or photographs while keeping apace of the INSPECTOR during the property review, but any oral or video recording is prohibited.  INSPECTOR guarantees to perform a visual, non-invasive review of the home/building and to provide CLIENT with a verbal, on-site consultation identifying the defects that INSPECTOR both observed and deemed material. CLIENT may, while on-site with the INSPECTOR, request (via written agreement) a Written Home Inspection Report which would comply with the Standards of Practice as described at www.nachi.org/sop; 75% of the below-stated fee for this consultation shall be applied to the Written Report Fee. Client may, after the on-site consultation, also request a Written Inspection, which would necessitate another on-site visit (unaccompanied by CLIENT); none of the below-stated fees shall then be applied to the Written Report. Verbal comments will comprise the bargained-for consultation. The consultation is only supplementary to the seller’s disclosure. This consultation is verbally relayed to the client, whose responsibility it is to understand and act upon it. A licensed contractor should evaluate all stated concerns and adjacent areas. Inspector denies any liability, as he has no authority to require that any party accomplish anything mentioned or suggested in this property review.
 
2. CLIENT understands that this consultation is not performed in accordance to the current Standards of Practice for Home Inspections by the National Association of Certified Home Inspectors posted at http://www.nachi.org/sop.htm. CLIENT understands that certain limitations, exceptions and exclusions apply, including sealed areas, sprinkler systems, spas, enclosed panel boxes, attic areas without permanent flooring, any crawlspace areas with less than 36" clearance, etc. CLIENT understands that INSPECTOR will NOT be testing for the presence of Radon, mold, asbestos, lead paint, formaldehyde, molds, soil contamination, methamphetamines or other drugs, and other environmental hazards or violations.
 
3. The consultation is performed for the CLIENT, who gives INSPECTOR permission to discuss observations with third parties. INSPECTOR accepts no responsibility for use or misinterpretation by third parties.   INSPECTOR’S review of the property is in no way intended to be a guarantee or warranty, express or implied, regarding the future use, operability, habitability or suitability of the home/building or its components. The scope of the review to be performed pursuant to this Agreement does not include decay or condition of the interior of any type of walls, foundations, roofs or similar defects that are not visible by a visual review.
 
4. INSPECTOR assumes no liability for the cost of repair or replacement of reported or unreported defects or deficiencies either current or arising in the future. CLIENT acknowledges that the liability of INSPECTOR is nil without a written report, and no claims can be brought against INSPECTOR for bargained-for verbal consultation without a written report. In the event of a claim against INSPECTOR, CLIENT agrees to submit, in lieu of litigation, any disputes which may arise in connection with the Review of the subject property, to mediation / arbitration under the Rules of the National Association of Certified Home Inspectors’ Alternate Dispute Resolution Service (www.nachiadrs.com). The Client and Inspector acknowledge that they are bound by the Terms and Conditions of the Review Agreement. The Client further agrees to be responsible for all costs associated with the request for mediation/arbitration. 
 
5. HOLD HARMLESS AGREEMENT: It is understood that this contract is between the CLIENT(S) and INSPECTOR(S), and that any REALTORS® are held exempt.
 
6. The Fee of $_________.00 (CASH) or $_________.00 (CHECK) is payable with this signed agreement (Make Checks Payable to: R. S. Spriggs). The CLIENT agrees to pay all legal and time expenses incurred in collecting due payments, including attorney’s fees, if any. This Agreement is not transferable or assignable. A licensed contractor should evaluate ALL noted comments and concerns in the Review Report prior to close of escrow. It is the CLIENTS responsibility to conduct a Walk-Through re-Inspection of the inspected property immediately prior to closing.
 
CLIENT HAS CAREFULLY READ THE ABOVE, AGREES TO IT, AND ACKNOWLEDGES RECEIPT OF A COPY OF THIS AGREEMENT.
